Hello Immigration help,My parents and I came to U.S 6 years ago. Two of my brothers left back in India because of age over. As soon as we got the green card, my mom filed for my brothers. They are still unmarried and still waiting and hoping U.S embassy would call them soon. Last week my mom turned to a Citizen. When she upgrade the status of the petition for my brothers, Will they get any credits for all these time they waited or they still have to wait as unmarried sons of U.S citizen? Any clue how long it might take? Thanks a million for any help. Jj.

Dear Jj:

Yes, they will have their approved petitions automatically converted to the family-based first preference category, and their priority dates will be the date when your mother initially filed for them. That means that they should now be eligible for immigrant visas. Good luck.

Hello Immigrationhelp, Once again, I need your help. NVC did upgrade my brothers petition to F1 category, but when I saw this month's Visa Bulletin board, am little confused. The priority date for f1 was 99 on earlier bulletins, but now its moved back to 95. whats really going on? How can they push back 4 years. My brother's priority date is june,96. Thanks in Advance for your help.

Dear Mr. Joseph:

Yes, it does sound confusing. What has happened is that there are thousands of other applicants just like you who have upgraded their petitions from the family-based 2B category to the family-based 1st preference category. As a consequence, the State Department has been forced to retrogress that category to make sure that others with priority dates before 1996 are given visas ahead of those with later dates.

We expect that this category should move forward again in the new fiscal year that begins in October. At that time, we believe that your priority date will be available. Good luck.

I became a US citizen last month , i have son who is in F2B category. What papers do i have to send to the NVC to upgrade is status to F1?

Hi Anonymous, you need to send a copy of the approval notice from NVC and your citizenship certificate and a letter requesting for the upgrade. If you want any further info, I am more than happy to help you.

After doing so, does the NVC send a letter notifying that his status has changed? if not what steps could i take to confirm that this was done?

I sent the required documents about a month ago.

Just send a copy of his previous approval notice together with a copy of your naturalization certificate and ask that his approved petition be upgraded to the family-based 1st preference category. Good luck.
