Dear Immigration Help,

I am a US citizen by birth. My husband is a British citizen in the process waiting for a green card. We live in New York City and filed all the necessary paperwork for Adjustment of Status last year. My husband received his Work Authorization Card and SSN in November, but we are still waiting for an interview date.

We are planning to move from New York to Colorado at the end of May. To make matters difficult, we won't have a mailing address in Colorado until after we arrive and find a house. It is also impossible to be sure if the next resident of our apartment will forward any wayward mail from the INS. Do you recommend hiring a lawyer to make sure the change of address process goes smoothly? If so, is it recommended to use a lawyer here in New York City or to find one in Colorado after we move?

We really don't see the need to hire a lawyer just for the change of address. In fact, you will probably be better able to handle it than an attorney, since that is such a minor matter that the attorney may not give it proper attention.

Obviously, it would be much easier if you could go to the New York office in person and give them your Colorado address before you leave and ask them to transfer your file. If that can't be done, you should still speak with someone in the New York office and ask them the best way to notify the office of your change of address and request a file transfer. Try to get them to give you a specific section of the INS office that handles those types of requests, and get the person's name who is in charge of that section. Then you can direct your correspondence directly to that person.

When you send your change of address and request for transfer of file to INS, make sure you do so by certified mail, return receipt requested, so you will have a copy for your records. Another good idea is to notify the INS Customer Service Center at 800 375-5283.

If you still feel that you would like to use the services of an attorney, it is better to get an attorney in New York since that is the office that you will have to deal with for the transfer of the file, and you will be in Colorado. Good luck.

I would like to know do I have to notify INS about change of passport and how do I do that?
My I - 485 is pending at Texas service center.

Since your I-485 is currently pending with the INS, and your current passport information is part of the application, you should notify the INS of the applicable changes. Good luck.

My friend sponsored her son-in-law from Mexico. Since then he has been in trouble with the law, not drugs or drinking. He has now returned to Mexico. Will she still be responsible for him if he returns, financially that is?. He never received his citizenship.

I am a resident in the process of becoming a citizen of the United States. In January I got married to my fiance but he is not legally in the United States. Since I am not 21 yet I cannot file a petition until I turn 21 or become a citizen. What I would like to know is wether it is possible for me to file a petition for my husband and if so should I hire a lawyer to make things quicker or just do it myself. Thank You.
