Sponsoring father died

I'm single and have an I-130 petition filed in 1989 by my US citizen father who recently passed away. My priority date is 1989 and currently the home country is processing 1988 petitions. Will the passing of my father negate the petition in my behalf. Shall I have my mother, who became a US citizen 2 years ago, file another petition for me.

Dear GoodSam:

By regulation, your father's I-130 petition was automatically terminated upon his death. If you feel that you could show extreme hardship, you can request the Immigration Service to allow you to retain the approval for humanitarian reasons. This is not easy, and we would suggest that you contact an immigration law attorney if you wish to seek that remedy.

In any event, you should definitively have your US citizen mother file a petition for you. Good luck.

HI MY NAME ELY I'D LIKE TO ASK WHERE CAN WE ASK FOR HUMANITARIAN CONSIDERATION BECAUSE OF EXTREME HARDSHIP. I DONT KNOW IF MY SETUATION CAN FIT, IAM UNDER LIFE BENEFIT PETITIONED BY MY US CITIZEN MOTHER THIRD CATEGORY WAITING AT LEAST 5 YEARS. IAM A IN LEGAL STATUS MAINTAINING STUDENT VISA M1. I WAS ADVISE TO MAINTAIN MY STATUS UNTIL I WILL RECIEVE MY APPROVAL OR STAY WITHOUT PERMISSION IN U.S. I WOULD RATHER MAINTAIN MY STATUS AND RETAIN MY CLEAN RECORD. HOWEVER GOING TO SCHOOL WHICH IM DOIN FOR THE PAST 2 YEARS IS VERY EXPENSIVE. I HAVE TWO BABIES TO TAKE CARE AND MY WIFE AS DEPENDENT. MY FATHER WHO WAS SUPPORTING US JUST PASSED AWAY LAST MARCH AND MY MOM WHO IS VERY OLD NOW HAVE A HARDTIME TOO. CAN THE EXTENSION FOR FAMILY BENEFITS I 817 CAN HELP ME? Dear Ely:

From the information you have supplied, we do not believe that you will qualify for any type of humanitarian hardship visa.

The I-817 does not apply to your type of case. It may be possible for you to obtain some type of practical training based on your student visa, which may be able to help you support your family. Speak with the student advisor at your school for more information on this subject. Good luck.

I have a boyfriend that use to live in Mexico, he came to the US about six years ago. His dad applyed for him to get his greencard in Mexico, but when he started working here in Oregon the immigration went to the work site where he was working and he was deported back to Mexico. Now he is in the US again,and now he was sent a letter from his family in Mexico saying that he got a letter saying that they had a visa number for him, but the later was about six months late. He has to little girls with me, I am do not have a greencard. What does he need to do to get everything done??

Dear Anonymous:

Apparently, the visa petition filed by his father is now current. He needs to get a copy of the letter sent to him by the consulate, and/or a copy of the I-130 approval notice, and proceed with his application for an immigrant visa or adjustment of status.

Because he had previously been deported from the US, and because he illegally re-entered, he will need a waiver. His case could be complicated. For that reason, we would suggest that he speak with an immigration law attorney as soon as possible. Good luck.

My father applied for me from USA, I have priority date of Jan. 1998, and my category is F2B. My father shall possibly get nationality in December, 2002. Will my priority date change, & will my category updated to 'un-married sons of citizens'. Will my priority date shall remain same with new category?

Dear Ajmal:

Assuming you are still unmarried, when your father becomes a US citizen you will automatically be upgraded to the family-based 1st preference category and you will retain your January 1998 priority date. That means that you should be immediately eligible to file for permanent residence. Good luck.

how & where can i apply for an request to Immigration Service for the approval for humanitarian reasons. i was filed on F2b catergory on january-1998 by my mom & currently she failed to clear citizenship interview & now she is called back after 3-months, my dad's citizen call is yet to be scheduled but he has not filed me on f2b if he becames citizen then what will be my status
