hi, i want to know if a mother get her citizenship in the next summer,could her children, married and above 21 years old, get greencard? and how and when, and what about their children? single or married and below and above 21,

Dear Farrokh:

A US citizen mother can file a visa petition for her married or unmarried children. It will also include their spouses and minor unmarried children.

How long it will take will depend on their preference categories and countries of birth. You can check this out by referring to the Visa Bulletin, which you can find on our Home page. Good luck.

My father and his American wife adopted me against my mother's wishes. My mother is and was then in Ecuador. Can I apply to bring her here now after 20 some years have passed. I provide for her now and would be able to keep her. My father is now dead and I am an naturalized American citizen and have married an American.I do have my original birth certificate.

Please go to our Home page and click on the link entitled "INS Local Office Processing Times". You will be able to see how long it is taking to process naturalization cases in San Antonio. Usually, fingerprint appointments are scheduled about 3-6 months before your interview on the application. Good luck.

Please go to our Home page and click on the link entitled "INS Local Office Processing Times". You will be able to see how long it is taking to process naturalization cases in San Antonio.

You do not state whether your husband is in the United States or in India. If he is in the United States, as soon as you become a citizen, he can file an application for adjustment of status. If the petition has already been approved, he can just file for permanent residence. If it has not yet been approved, we would suggest that you submit a new petition with your husband's application.

If your husband is in India, you should notify the Texas Service Center that you have become a citizen, and your previously filed petition will be upgraded to the immediate relative category. A form for that purpose can be found on our Hints & Tips page by clicking on the link entitled: I-130 "Upgrade Request" Sheet for Use at Texas Service Center (01/03/01). If the petition has already been approved, you would notify the National Visa Center that you are a citizen by sending a copy of your naturalization certificate. Good luck.

Hi?
Me and my spouse are both foriegn citizens. My wife is a student. But I'm not. Since I came to this country I have being filing my Tax returns every year. Also we have a child who born here. Please tell me there is any way we can stay here longer with our child so she can keep her citizenship or there is any way we can get green card considering our situation?

If your child was born in the US, then she is a US citizen, and will retain her citizenship even if you leave the United States.

We don't have enough information about you or your wife to advise as to whether there might be some way for the both of you to obtain permanent residence in the US. You should contact an immigration law attorney for a consultation, as it is possible that you and/or your wife could qualify in some way to remain in the US. Good luck.

Dear Immigration Help!
I received Green Card in 1996 and submited the petition I-130 for my unmerried son 21-year old son.
This petition has been approved (notice date was October 1,1996).
On October 18,2001 I became US sitizen and submited "Upgrading of appoved I-130 petition" with proof of my Naturalization.
Please, tell me how it will reflect on my son's waiting for visa. How long he will wait for visa as child of US sitizen?
Will NVC consider his waiting time from 1996?
Can you advise me web site where I can get detail information about my case with using my receipt number?

Dear Anonymous:

Your son's priority date of 10/1/96 is now current. Therefore, as soon as the NVC upgrades the petition, your son can begin the process of applying for his immigrant visa.

There is no web site that will allow you to check on the status of a pending case with INS or the State Department. The INS is currently working on a program that may allow persons to check on their cases over the Internet, but this will not be operational until at least the middle of next year. Good luck.
