I read somewhere that if one is subject to 245(i) he MAY be required to pay $1000..does this mean some people are not...please help..I'm confused..

You do not have to pay the $1000.00 penalty fee if you have never been unlawfully in the US, or if you entered legally and are the immediate relative of a US citizen (even if you are now illegal). You are considered an immediate relative if you are the spouse, parent, or minor child of a US citizen. For a parent, the child must be at least 21 years of age.

The following is my situation: I filed I-129F for my fiancee one year ago, but after he entered U.S., i did not marry him because i found out he never love me; now, i found a true love, he entered U.S. illegally without inspection; my question is can i file a petition for my husband in order to have him grandfather under the new law since i had filed for my ex-fiancee? Will this petition cause me into any problem? My previous petition revoked not at fault of me.

Yes, you can marry and file an I-130 petition for your husband. You must file the petition on or before 4/30/01 for him to be grandfathered.
You should have no problem because of the previous fiance petition that you filed, unless you did so just to help him enter the US, and never had the intention of marrying him. If you did not marry for the reasons that you state, then you will be all right. Good luck.
