Step-parent and over 21 son

I am a citizen and have been married for two years. My husband is a resident alien. Can I petition for my step-son/daughter over 21 years of age or just for minor step-children.

Dear Julia:

You can only petition for your step-children if you married their father prior to their 18th birthday. Since you indicate that you have only been married for two years, and they are over the age of 21, you would not be able to petition for them.

However, your husband should immediately file a petition for them. He can obtain citizenship after 3 years, since he is married to a citizen, and then they will be converted to the 1st preference category, with the priority date as of the day when their father filed the original petition. Gia dinh toi duoc cha toi bao lanh ( ho so goi hoi thang 12 nam 1999.) Hien toi co 1 dua con vua dung 21 tuoi . Nhu vay khi no duoc chap thuan cho di dinh cu o My ma con toi da tren 21 tuoi thi co duoc di theo cung khong ? Neu khong thi chung toi phai lam sao de con chung toi cung di theo vao thoi diem chung toi duoc chap thuan cap visa khong ?
