I married my long time girlfriend and we had an interview last year on August 2000. At the interview the officer told us to bring a letter from the landlord and the affidavit of support for November 2000.

I was unable to obtain anyone to sponsor me, so i failed to attend the november 2000 appointment.

Now that 4 months have passed, do you think INS has closed my case. i failed to tell them to reschedule. if my case has been closed, do i need to resubmit the i-130 and i-485?? or can i reopen my case?

also, regarding the affidavit of support. we are 4 people in my household. me, my wife and my wife's 2 children. Can i sponsor myself, meaning can i fill out the form with my information, since this year I earned $19,000.00.

yet, last year i earned $8,000. please help me. by the way my wife does not work.

by the way i am the beneficiary and my girlfriend is the petitioner, USC.

First you will have to contact Immigration to find out if your case was denied for lack of prosecution, or if it is still open. If it is open, you can ask INS to reschedule. If it has been denied, you can file a Motion to Reopen. If the motion is denied, you will have to file all over again.

As for the Affidavit of Support, if you and your wife have lived together for more than 6 months in the same household, then you can use your income to meet the poverty guideline requirements. Your wife would fill out the I-864, and you would fill out the I-864A. Good luck.

It depends on whether you are subject to the 2-year foreign residence requirement. If you are not, then you can go ahead and file an application for adjustment of status.

If you are "subject", we would suggest that you speak with an immigration law attorney who is very knowledgeable in this area in order to obtain information on how to file for a waiver. Good luck.

Did the consular officer explain why you were not eligible for a waiver? If the only ground of inadmissibility is that you remained in the US unlawfully, then you would be eligible for a waiver based on marriage to a US citizen.

I (United States citizen) applied for my wife and my step-children using the K3 K4 petition a year ago. To date, this petition has not been approved by the Chicago Service Center. As of today, I only received a receipt notice for I-129F and separate receipt notices for I-130 I filed for them. Since k3 K4 is the family unity law, why is it taken so long? What can I do to speed up the process?

I am married to a US citizen, he sponsored my greencard application last year, now it is still pending, but I am having EAD and advance parol now. The problem is we cannot get along at not long after we got married, we have too much difference!

Now I am in love with another US citizen, we cannot wait to get married ASAP and start a family together. But due to the greencard card issue with the current spouse, I don't know what to do. Do I need to start over again after divorce and marry again? Is my current EAD still good in between time?

I am writing to you to a matter of great importance to my husband and me. I got married to a USA citizen in Mexico on december 2001. We worked on the papers for alien relative and I was interviewed by the counsellor officer at Ciudad Juarez on July this year. I was denied the visa based on
212a6cii because of an accident that happened in Niagra Falls on July 2001. My then fiance (now my husband) and I tried to cross the boarder telling
a lie. I was living in Canada since march 2001 and there I found that I got a scholarship to do a master program in Mexico. So I decided to
travel there and leave Canada. My fiance and I thought why not to spend a time together in Washington D.C. That was the reason why we did that. Now we understand that was fool. The problem is this: when I was interviewed by the officer at the boarder in Niagara I said what
my fiance suggested me "I was born in Wasington D.C" and then I could no go more I stayed in silence. My fiance discuss with the officer and then he was sent to another room. The officer did a file on my data and I singed that paper without reading anything I was shocked about what happened over there that day. At the interviewed in Ciudad Juarez the counsellor asked to me "what happened, what happened? tell me the true". I started telling him all in very detail. When he said "oh that happened" I looked at him surprised and Then he said "I knew that before that was in the record" and he denied
me the alien visa. Telling me that there is no waiver, that my name would be on the system for 85 years and when I said to him. What can my husband do now? he said "congressman" "I can not explain to you I can not in spanish" It was to hard for me I have to leave that office . I just tell him that it was a huge charge for a mistake we did
because we just wanted to spend some time together.
What can we do now? what is our situation? Is there a way to get a copy of the report made by the officer at Niagara Falls?

I recently married a student on an F1 Visa. Everything is ok and we

Except this one problem. She has been working off campus in excess
of 20 hours without authorization.

Will this be a big problem with the change of status?

Should she even list her employers on the I-485 application?
