First you will have to contact Immigration to find out if your case was denied for lack of prosecution, or if it is still open. If it is open, you can ask INS to reschedule. If it has been denied, you can file a Motion to Reopen. If the motion is denied, you will have to file all over again.
As for the Affidavit of Support, if you and your wife have lived together for more than 6 months in the same household, then you can use your income to meet the poverty guideline requirements. Your wife would fill out the I-864, and you would fill out the I-864A. Good luck.

Assuming your boyfriend is a US citizen, you can file for adjustment of status in the US without the need to leave.

Technically, you do not need to meet the income requirements at the time of filing, just at the time of the final interview. However, you should check with your local INS office to see if they will let your husband submit his affidavit now, and the joint sponsor at the time of the interview. Good luck.

Did the consular officer explain why you were not eligible for a waiver? If the only ground of inadmissibility is that you remained in the US unlawfully, then you would be eligible for a waiver based on marriage to a US citizen.

When he said "oh that happened" I looked at him surprised and Then he said "I knew that before that was in the record" and he denied
me the alien visa. Telling me that there is no waiver, that my name would be on the system for 85 years and when I said to him. What can my husband do now? he said "congressman" "I can not explain to you I can not in spanish" It was to hard for me I have to leave that office . I just tell him that it was a huge charge for a mistake we did
because we just wanted to spend some time together.
What can we do now? what is our situation? Is there a way to get a copy of the report made by the officer at Niagara Falls?
