A strange family immigration problem

My uncle who is a U.S citizen born in iran, filed for family based immigration of my father and the whole family in 1990.
now we have received forms I864 , I864A, I865.
The problem is that my uncle is living in Iran at the moment and he will not get back to US till next year.
1-Can some one else n US be our sponser?
2-As he has no tax return since 3 years ago what should we do?
3- although I ws 15 years old in 1990 , I am 26 at the moment. Can i use this visa or as I am more than 21 , I cant ?

Dear Arash:

Since your uncle was the petitioner, he must sign the affidavit of support. If he does not have enough income and/or assets, then someone else can sign an additional affidavit of support.

Your uncle must establish that he is residing in the US. He will have to explain why he does not have income tax returns for the past 3 years and, if necessary, he will have to file tax returns at this time.

Since you are now over the age of 21, you cannot be issued an immigrant visa based on the above-mentioned petition. You will have to find another method of obtaining an immigrant visa to the US. Good luck.

Please HELP!!! My daughter is 16. She has a baby and is pregnant again by the man she wants to marry. He is an illegal immigrant and is in jail for the statetory rape of my daughter. We are trying to get them married. He is a good man and I would be honored to call him son. How can I get them married and get him out of jail so he can take care of his babies? I am running out of time.
