Hi. I'm a US citizen. My girlfriend of 18 months is here in the US on a visit from Australia and we now want to get married while she's still here in the US. Her 90 day visa (waiver) expires in 2 weeks and we need to know what the consequence is if she over stays her visa. We don't plan to marry for another 3-4 months. Is there a problem with this and could she have a problem getting residence or an advance parole after we marry because she over stayed? We have extensive proof (eg photographs) that we've had a bona fide relationship for the past 18 months (I was based in Australia for employment for 2 years which is how we met). Thanks for your advice.

Dear Anonymous:

If your girlfriend files for residence after her stay expires she would still be eligible to adjust status in the US, and would not have to pay the penalty fee. However, she will not be able to obtain an advance parole.

Also, keep in mind that she will be here unlawfully so if she is apprended by INS before she has filed her application, she could be removed from the US, even if she is planning on marrying you and filing for residence. Good luck.

I came here with a student Visa. After finishing my courses, I changed to Tourist Visa. Now I want to marry my boyfriend, who is a US citizen. Will I have problem with that? I heard that I cannot get marry with B1 VISA. Is it true? Do you recommend that we get marry in my country?
