How to bring my wife to US ?

I am a US citizen and got married in India. What is the best way(in terms of time and legally) to bring my wife to US and how long it is going to take to bring her to US?

I spoke to one of the immigration lawyers and he told me that I have to wait for 7-8 months, is that right. Is there any faster way?? Also, someone told me that I could have applied at the US embassy in India and could have brought her with me, is that correct?

Dear Paul:

You should immediately file an I-130 petition for your wife with the INS service center that has jurisdiction over your place of residence in the US. Then, when the K3 visa regulations come out (which should be in the next 30 days), you will be able to file a K visa petition, which hopefully should only take a few months to approve.

Then the case will be sent to the US consul in India where your wife will be able to obtain a K3 visa to enter the US.

You can always attempt to file the I-130 at the consul. While the consul has jurisdiction to handle these types of cases, in most situations the consul will tell you that the petition must be filed with INS in the US. You should call the consul and ask them whether they will accept the I-130 if both you and your wife appear in person. Good luck.

Dear Paul:

All references to the US consul referred to the US consul in India since the US has no consuls in the United States.

The length of time it will take to bring your wife to the US depends on how quickly you file the petitions, how quickly Immigration issues the new K3 regulations, how quickly the petitions are approved by INS, and how quickly the US consul in India issues the visa. Because of all the variables, the time period could be as little as a few months, to as long as eight months or more. Good luck.
