Hi, my father (American Citizen) files petition for my brother and his family, who are in India now in July 1996. The priority date for this category is 8 March 1996, which means that still two months left. Our problem is my brother's son will be 21 years old on 2 of July. They already got papers from American embassy and they went to American Embassy based on one paper in the package they recieved, which say "if any of your child is 21 or going to be 21, please let us know." But the person at American Embassy said that we still need to wait for the priority date.
The priority date March 8, 1996 still on the same place for the last few months. If the INS would not change the priority date next months also, then I think is less chance to get visa for my brother's son. Can you please let me know what should be do in order to get visa for him ?

Dear Anonymous:

Yes, you do have a problem. The priority date must be current in order for your brother's son to receive an appointment, and immigrant visa. If the priority date is reached, the consul can request an expedited visa number so that he can get the visa before he turns 21.

All he can do is hope that his date is reached. If it is, the consul must be notified immediately as he must be issued the visa, and he must enter the US, before he turns 21. Good luck.

Hi.I have question regarding age out. My father applied for adjustment of status on family based petition. The priority date was current in may 2001. i also applied as dependent on him and Boldly wrote on application as age out case asI will be turning 21 years in march 2002. At the time of filling the officer told I will not have any problem as my case has already been filed. I also got EAD. Now my case is TSC sent by INS office in carleston SC for I-181 appoval. What is this I-181? what benifet I will have if itnis approved. I spoke with INS customer service he said Imy still needs to be approved befor 21 years of age . What can I expect? my finger prints will be taken on dec 14T tomorrow) I
Please advise the possibility of getting greencard

Dear Anonymous:

From the information you have provided, it appears that INS is working on your case and is trying to get it approved before you turn 21. Your fingerprints still need to go to the FBI for clearance.

We would suggest that you keep checking back with INS on a regular basis to make sure that your case is still progressing, as it is vitally important that you get your approval for residence before you turn 21. Good luck.

Dear helper,

My grandfather (a US citizen) has filed a petition for my mother in F3 (married sons and daughters) category in November 1999. At that time my age was 16 years. The visa call is expected none earlier than 3 years. So, according to rule I won’t be able to go with my mother as my age will exceed 21 years.

I heard of “Child Status Protection Act” and checked it on some website (it was like thomas.loc.gov) and other sites but I could get no important information.

I want to know whether I will be able to go with them (according to this child act) irrespective of my age exceeding 21 years OR they will deny my visa.

Please tell me if u need any further information for giving solutions.

I m on completion of 21 years of age in 2004.We had sent the form ds-230 part-I form for family based immigrant visa,but we didn't get the reply from them.So i just want to request u to take fast action for medical & interview process so that i can reach there before time.

hi i was petition by my mother and now that my priority date is fast approaching im afraid if i would passed the medical exam coz i was examined to have a hepa-B, my question is do US embassy will still permit me to approved my visa even though that i have that desease?
