I sent the I-129f forms for the K-3 visa, and it didn't say anything about sending a birth certificate for my spouse who lives out of the country. It just said to send in My US birth certificate. Was I suppose to send his as well???
Sabrina, the birth certificate or copy of passport or naturalization certificate is required as a proof of the petitioner's U.S. citizenship. The beneficiary's (spouse) birth certificate is not required for the I-129F.

Renuka, I heard that you have to show/establish residency in India before the consulate in New Delhi will accept the petition. You may have to show some evidence that you are an American citizen living in India who needs consular services. Otherwise, they may ask you to file at the INS regional service center. Good luck!

Can you tell me when the new K-3 visa regulations will be out. Where to get the application form for that??Do I have to file for K-3 visa in usa or in us counsel in India??I am a us citizen and I have already filed the I-130 form to bring my wife to usa.

The regulations are expected by the end of this month, but nothing is ever sure when dealing with Immigration. We would expect that the regulations will require that the petition be filed with INS in the United States since the purpose of the petition is for INS to confirm that an I-130 has been filed and is either pending or approved.
As soon as the regulations are out, they will be posted to our web site, with complete details. Good luck.

My K3 application was returned to me and they asked me to forward it to Nebraska. Are they Processing K3 as well? Or, are these morons thinking that I am applying for the K1? Its quite clear on the application what my intentions are along with my marriage certificate and I130.. I have forwarded the papers. I hope they are not wasting my time....I am live in Pennsylvania....

It is strange to know that the K3 application was returned back! Did you send the I-129F petition for the K3 visa to the INS P.O. Box address in Chicago (as directed in the regulations and also indicated on the form)? Did you send it after August 14th, when the K3 regulations were published?

FYI, here is a checklist of documents/forms required for filing the I-129F to obtain the K3 visa:
1. Completed Form I-129F
2. Biographic information G325A for petitioner (U.S. Citizen)
3. Biographic information G325A for beneficiary (Spouse)
4. Typical INS photo - one each for self & spouse
5. Copy of marriage certificate
6. Proof of Petitioner's U.S.Citizenship i.e birth certificate or copy of passport or naturalization certificate
7. Proof of filing petition I-130
8. Filing fee of $95 payable to INS
Of course, other documents regarding name change, previous marriage etc., may be required based on special circumstances.

I did send it one week prior to their announcement. The PO Box in Chicago is the same. They ask me to forward my documents to Northern service center in Nebraska for processing. What the hell?? I called INS and they said only Chicago is processing K3, so I think somebody up and it has cost me time. I am going to send a new app to Chicago with A BIG K3 APPLICATION ON IT. IDIOTS!!!

i have filed my case I-130 on may 30th at the vermont service center and got my reciept on august 11th. Can i still file for the same case I-130 abroad at new delhi embassy. please suggest. i want reapply again at new delhi, because they are faster than here. I want to know what can happen if i refile again. Is there any harm to do that.

If the US consulate in New Delhi is willing to accept jurisdiction of your case, you can file a new petition at the consulate. Good luck.

The chicago office started sending NOA. I know I know.. what you all wanna know....
It says....
"The above application received. IT USUALLY TAKES 30 TO 60 DAYS FROM THE DATE OF RECEIPT TO PROCESS THIS TYPE OF CASE..."
To obtain case staus they have given NCSC number (1800-375-5283)....
BUT the next line says....
"Information regarding case status is not available at this number"

(Whose k-3 visa is sent to Nebraska). It happened with me also. It is clear cut mistake on behalf of INS. You must send it to Chicago from where it is sent to Missouri for final processing.
