Divorce affect Naturalization?

Dear sir,

I married a U.S. Citizen in 1998. And I filed
Application for Naturalization N-400 in May 2001. Unfortunately, our marriage have to come to an end. We got divorce in October 2001. I just wonder if I am still eligible for applying for naturalization. Will my divorce affect naturalization interview later on?

Dear Anonymous:

You would not be eligible for naturalization based on the 3-year rule since you are no longer married to a US citizen. Unless there was some immigration fraud in your marriage, the fact of your divorce will not affect a future application for naturalization. Good luck.

What you meant is that even if the marriage had been 3 years when the N-400 was submitted, when INS schedules an Naturalization Interview(about one year later),at that time, if you divorced with the U.S. citizen, you are not eligible for naturalization?

Is that case true,I have to wait 5 years after LPR to apply for N-400 again?

I want to clarify that when I filed N-400 in May 2001, our marriage had been three years, we were living together, and my spouse had been U.S. citizen for the past 3 years. That is as per what my understanding of INA319.

So, as per your answer above, there should be otherwise stated provisions in law different than INA319?

My question is: will INS officials deny my application for naturalization at interview when they find out that I divored citizen spouse 5 months after filing N-400? exclusivly for the ground that my current marriage status is divorce to that Citizen spouse?

Dear Anonymous:

We realize that you had been married to your US citizen spouse for more than 3 years before filing for naturalization. That is the only way you would have been able to file under section 319.

However, when you go to the interview, you will no longer be married to and living with your spouse. Therefore, INS is prevented by law from approving your application under section 319. You will have to file a new application once you have been a resident for 5 years, under section 316. Good luck.

Dear Immigration Help

I had my N-400 interview just one month ago.
The interviewer told me that i have passed but they are still awaiting for my background check to come back...
Now I just moved a few days ago and I haven't informed the INS at this time, but I have my mail forwarded to my new adress, same city and state. I am concerned that once i have my address with the INS that the whole oath ceremony might take even longer....
Do I have to notify the INS, and if yes how do I go about it? Do i have to file or fill out a certain form?

Hello,

A friend of mine is in the military. He married a woman to help her get her citizenship. They do not live in the same state, but they plan to go through with this until she is a citizen. I keep trying to tell him that it is a dangerous situation. Can you give me any amunition to get him to stop with these lies and just file for a divorce? Please help !
