I am an unmarried Canadian. 47 years old. Born in Canada. My father was a Canadian citizen all his life but was born in the USA (in the 20's). My father, according to USA law could claim US citizenship but never did. My father is deceased (1990). Does the fact that my father was born in the USA give me any priority at all in applying for USA immigration status? Thanks.

Dear James:

An immigration law attorney, or the Immigration and Naturalization Service, would need to have a lot more information about your father and you before they could tell you whether you may have acquired US citizenship at birth.

Just from the brief facts that you have provided, we cannot tell whether your father ever met the physical presence requirements of section 301(g) of the Immigration and Nationality Act to be able to confer US citizenship upon you.

We would suggest that you review said section of law, and if you feel that your father may have qualified, then you would be well advised to speak with an immigration law attorney. Good luck.
