HI,
i ahv married a permanent resident in america and was on H1 visa there.. due to layoff i hav comeback but my wife is still there.. she has recently filed I130 along with biographic form.. how long would it take to get the eac no from ins.. and as she is living in Olean Western NY so what would b the district office for that area or local office of INS and how long would it take to process the case from teh reginal office and approximately to get my fingerprints or hav an interview in my country embassy for the greencard.. and also i want to visit my wife in the mid of next year 2003. can i apply for the visit visa then.. or any special category visa??
and also i hav a rumor that INS are processing teh cases very fast now.. is that in your knowledge came in some news channel in Jan..

Dear Anonymous:

If your wife is only a permanent resident of the US, you will not be able to get your immigrant visa for about 5-7 years, unless she becomes a US citizen.

It really does not matter how quickly INS approves the I-130 petition, because you still cannot come to the US until you receive your immigrant visa.

You will have a very difficult time obtaining a visitor's visa to visit your wife if she is a permanent resident and has filed an immigrant petition on your behalf. The consul will believe that you are an intending immigrant and do not plan to return to your country to wait for the issuance of your immigrant visa. You will have to convince the consul that you intend to visit only, and that you will return prior to the expiration of your authorized stay. This will not be very easy to do. Good luck.

hello i am 16 years old and i am a green card holder residing in jamaica. My greencard expired in 2002 while i was in jamaica. i was informed the i am to apply for an immigrant visa through SB1. The processing taking place is as if i have never been in the united states. Is there an alternative procedure to get me back to amaerica to renew my green card? i have been in jamaica from 2001 and i have not been back to america since. is there another way other than the frustrating SB1?
