Hi:
Dear Anonymous:
I130 was approved when my spouse was green card holder, and the I130 petition indicated that it would be with INS Service center till the visa was available. My spouse is us citizen now. How do I upgrade the petition? I wrote to National Visa Center they said they do not have the file. What do I do?
my moms i-130 has been approved since 1990, the intent has always been there but we never got the notice..since it went to a different address and we found out that the household help at that time of my uncle threw the letter!!! it was only now since my aunt who petitioned my mom called that she said that we were approved already and she wants us to be with her a.s.a.p. what can I do? i need advice and help here...thanks.

If your I-130 petition is still pending with the TSC, go to our Immigration Hints & Tips page and click on the link entitled: I-130 "Upgrade Request" Sheet for Use at Texas Service Center (01/03/01).
If the petition has already been approved and is at the NVC, then simply send them a letter with a copy of the approval notice and a copy of your naturalization certificate. Good luck.

My I-130 for my wife is pending at VSC and I will become a USC soon. Can I ask VSC to upgrade the I-130 application or do I need to file a new I-130 for my wife in the IR category? If VSC allows me to upgrade the old I-130, will the priority date change? How do I send an upgrade request to VSC? Thanks a lot.

As soon as you become a US citizen, you should notify the VSC of that fact by sending them a copy of your naturalization certificate. You would send the notice to the same address where you sent the I-130 petition. Make sure you clearly mark the envelope so that it will be given priority treatment.
They will upgrade the pending petition to the immediate relative category, without the need of filing a new petition. Good luck.

I have a question that I’ve been trying to ask to some one who knows better. But I don’t know any body that knows about this question very well. I hope that you’ll answer to my questions
I have a friend who is a U.S Citizen. She got married to some one in India and she filed the petition I-130 for her husband after she got married (as I believe, for citizens it takes less time to call people to U.S. Usually I’ve seen it only takes 3-6 months but I don’t know why she never heard any thing from INS until 2 years. Then she went to Delhi U.S Consulate (In India), and filed it again over there, and after that within a two months she heard from INS and in a month her husband was able to come to U.S. Does it take that long even for the Citizens too to call their spouse from here? I mean, it should only take 3 to 6 months only right? If not, how long should you think it should take for the citizens to call their spouse to U.S from here?
I’m asking because this is the third time I’ve heard now from people that I know that happened to them and I’m worried because I got married to some one in India when I was a green card holder and now I just became a Citizen and now I have to send a letter to upgrade the petition for my husband. And so, I’m curious to know how long more will it take for him to come here as now I am a Citizen.
Oh yeah, I have another Question to ask you,
I found out that I have to send a letter to upgrade my husband’s petition. Can you type and send me what exactly do I have to write in the letter.. I mean like an example…. from starting to the ending? I’m asking because I don’t know what should I type in the letter as its new for me…
And I found out, that I need to send
1) the copy of my Citizenship’s certificate, and
2) the copy of “Notice of Action” letter that I received for the petition that I filed for my Husband.
With the letter that I’m gonna have to send it with.
Do I need to send any thing else with it other than the above?
Please kindly help me with this….
Hope to hear from you soon…
thank you...
