Dear Immigration Help would you please answer my question: I got married 25 years ago.Got Green Card after 6 months.We divorced 2 years after the day of marriage.
Divorce certificate states that reason for divorce
was :desertion (on my part). Is that reason for divorce going to make me some difficulties at citizenship interview?

Dear Mike:

It should not be a problem. Unless INS has some reason to believe that your marriage was entered into in order to evade the immigration laws, the fact that you obtained a divorce two years after your marriage will not affect your case. Good luck.

I have recently been granted my green card, my marriage has been floundering for the last year.
If I were to divorce my husband before the 2 year period is up. Would I lose my green card.

Dear Anonymous:

If you only have conditional permanent residence, and divorce before the second anniversary of your green card, you would have to file for a waiver on immigration form I-751.

As long as you can prove that the marriage was entered into in good faith, and was bona fide, the waiver should be approved. Good luck.

My Brazilian friend had married a US citizen (K-1 Visa) in 1991. Within a year they visited Brazil; Her husband returned to the USA, she stayed in Brazil. They have not seen each other since that time (over 10 years. What is the best way she can get a divorce from him?

My Sister came here in US on Fiancee visa in 1999 and got married within 90 days per law .
Her Ex husband came to US when he was a child . He is a US Citizen.
She got married to him in August 10th 1999 .. They had a baby in July 2001 . Because of issues with his parents they got separated in October 2001 and She filed for divorce in November 2001 . They got a divorce on August 16th 2002 ( They were married from August 10th 1999- August 16th 2002... so only a few days over 3 years)
She got her Conditional Green card in Sept 4th 2001 (which should have been unconditional to begin with as 2 years of marriage were complete on August 10th 2001..it was later changed to unconditional Green Card in April 2002).. So she has Green card since Sept 2001. As She was married for a period over 3 years to a US Citizen and has Green Card since Sept 2001 .. Will she be able to apply for her Citizenship in Sept 2004 (after 3 years of Permanent Residence or will she have to wait till completion of 5 years of Permanent Residence)

Please advise

My russian wife has now made it clear that her reason for emigrating to the US and marrying me was to spare her sons conscription in the russian armed service our 2 year anniversery in in august 2004 and we have not had a green card interview yet I am best off filing for divorce prior to august or just wait for the interview and testify I do not have a functional, legitimate marriage made in good faith ?

the person who posted apr 10. regarding being used for greencard. NOT ONLY DID HE DECIEVE ME , HE RUINED MY CREDIT,MY WHOLE LIFE I BUILT FOR MY SELF. THEN THREATS TO KILL ME IF I LEAVE BEFORE OUR SECOND INTERVIEW. I STOOD MY GROUND TODAY IN COURT AND REFUSED TO SETTLE FOR A SIMPLY DIVORCE. I have been married on paper for the past three years, my wife is constantly overseas. over these past three years she had been in the united states for a total of nine months. She has two kids one thirteen the other 20. during these three years I have took on the responsibility of careing for the by my self. She has a green card but has not made a final interview because she is never in country.

Hi, I'm immigrant from Russia. I came to the USA on
fiancee (bride) visa. I got married on American
citizen. My husband and I have premarital agreement
where I don't get any alimony in case of divorce. I don't
work. I'm about to get my US citizenship (I'm waiting the letter with date for Oath Ceremony). I heard that
if I divorced my husband before I get my American
citizenship my husband must support me even if our
agreement said "he will not support me after divorce".
We are not divorced yet.

There are emotional(like I must stay at home all the
time and he punish me if I'm a bad girl) and physical
abuse too. But he's never hit me. I talked to an
attorney about abuse. He told me that it's not good
enough abuse to get support from my husband because our
premarital agreement.

Could you please, give me your opinion on my
situation?

1. Is it true if I divorce my husband before I get my USA
citizenship he must support me even if our premarital
agreement said that I refuse from any alimony or
support.

2. Will my husband obligated to support me in
case I have a job(with salary $7.50/hour)?

3. If he must support me after divorce-how soon he start giving me a money?

I want to get a divorce from my wife, she cheated on me we broke up but Im only a legal resident, they granted me another year while they review my case. But I dont want to wait that long to get a divorce its already been three years since we've been apart and we have two kids, I dont want this to mess up my case Please help I need to know if I should wait or do it now

My husband and I were married in a beautiful ceremony last year. However, right now we are having problems within the relationship. It may be teething issues.I have just recieved my work number and s.s number but not our first interview yet with Immigration. If (last resort)we were to file for a divorce before the date of the interview will this ruin my chances of a Green Card? I know you have to be 'seperated' for 6 mths. We both want our marriage to work. I am worried though of where it would leave me here in this country leagally? We also have a house. Am I entitled to anything?

Looking at these questions it appears a marriage must last 2 years before your foreign born bride becomes a citizen in her own right. Saw this above, will a pre-nupital agreement, ie no support in the event of divorce hold up in court?

I am a US citizen who married foreigner 10 years ago. We had several kids together and just found out that she is still married in her country. My lawyer states this is bigamy and my marriage can be annulled. I found that I can send the proof of her marriage to INS and the family law court for possible custody of the kids. She claims that she will tell everyone that I forced her to put down zero prior marriages on the marriage certificate and INS forms even though I questioned her when she lied. She indicated that her divorce papers were still abroad and it would delay the process. She would be able to show documentation later, if needed. All lies. My question is what will happen to her when I report her since she has American born kids. What will happen to me?

I married a man from the Middle East-Four yr's ago. In that four years we live together maybe one year- He move out after getting a job and fraud the INS.and FEDERAL INCOME TAX and myself. Now I receive divorce papers from him. I think he is still waiting on his perm. res.to stay in the states. could he be in trouble for frauding the INS and Federal Income Tax and be sent back to his country?

I am living with a women who seperated from her amrican husband. It seems like it was a marriage of convience. She just wanted to live here in the US. Her husband was married at the time of their wedding and not legaly divorced. They married a 2nd time but ran off while he ws working abroad. I am not sure what is next? She is living with me right now. Will she be deported? I just found out all this informaion.
