hello,
i need help.. ok, i enetered the country as a student, in 1995, and in 1999 i got maried to american cetizen, she left me to live in another state , now we are planing to devorce and the reason that she deserted me, it has been more than two years we've been maried. is there any way i can apply for a green card, i have a brother who is gonna be a cetizen in augest of 2001, can he petitions for me, can i stay in the united state while the application pending. is there hope, is there any layer would help in this case... confused, help????

Dear Confused27:

If your US citizen spouse is not willing to petition for you, there is no way that your marriage will assist you in applying for residence.

If your brother becomes a US citizen he can petition for you, however, the waiting list in that category is more than 15 years long, and you will not be permitted to remain lawfully in the US during that period of time.

We don't know if you might qualify for residence in some other way, such as through employment. We would suggest that you consult with an immigration law attorney, who can review all of the facts in your case, and give you more complete information and advice. Good luck.

actually i met a moroccan girl who had got her green card through Lottry. we are deciding to get married, but is it possible for me to get my green card through marrying her while she is not yet a US citizen?

Dear Anonymous:

If you marry someone who only has a green card, she can file a petition for you, but you will go into the family-based 2A category, which currently has a waiting list of about 5-7 years.

The only way that you can get your permanent residence faster is if she becomes a US citizen. Good luck.

I met a girl from panama in the us, she was married to a US citizen and lived with this person together for 7 years, but now is divorsed. I am not sure what type of passport or green card she has. I do know it's expired. I'm a us citizen not married to her yet, but we have a child together and live as a very happy family. She is under propation for five years. My question is: I would like to know what is the steps that she and I must take. I want to married this person, would it be a problem. Any info. would be greatly appreciated.

If i marryed a girl who was a u.s citizen and always had been , does that mean i can live, work and such there with no problem.
