Hello,
I would like to know if a pregnant woman can travel to the US on a visitors visa and deliver the baby there to obtain a US citizenship for the baby and a US passport??
Does the baby automatically becoame a US citizen
with benefits to the parents as well and can there be any problems for the mother with the INS on her return to the country of origin.

Dear Dennis:

Unless the mother enters on a diplomatic passport, her child born in the US will be a US citizen. However, the parents cannot derive any direct benefit from their child at that time. When the child turns 21, he or she can then file for permanent residence for the mother and father.

There should not be any problems with INS if the mother does not violate the immigration laws of this country, and merely having a child born in the US is not a violation of US immigration laws. Good luck.

I want to clarify the message above. If the pregnant mother delivers a child in the US only with a diplomatic passport can make a child Us citizen. And if the mother enters on the tourist visa, it wouldnt make the child a US citizen is it correct?thanks

Yep! It doesn't matter what passport you're the holder of...Or you could be illegal, too, and your child will still be a US citizen by birth!

We think that my two cents may have misunderstood your question. As we understand it, you are asking whether a child born to a person who is in the United States serving in a diplomatic capacity is a US citizen by birth?

The law on this issue reads as follows: A person born in the United States to a foreign diplomatic officer accredited to the United States, as a matter of international law, is not subject to the jurisdiction of the United States. Therefore, that person is not a United States citizen under the Fourteenth Amendment to the Constitution.

On the other hand, if you are asking whether a child born to a person who is in the United States on a tourist visa, and is not serving in any diplomatic capacity, is a US citizen by birth, the answer to that question would be yes. Good luck.

I'm currently in Orlando with my wife in order to buy a holiday home. The process took longer than we thought & now we cannot travel back to the UK in time for my wife to have our baby - it's due next month & the airline won't let us fly!
We are from the UK & travelled here on a B2 visa & need to know how long we can stay here after the birth of our child..?
Are the parents of a US-born child allowed to remain in the US indefinitely..?

You can extend your Visa by requesting to INS and let them know the facts. They will extend your Visa.
For how long? It will be depend on your request and reviewing officer.
As the parents, You cannot stay here indefinitley. Wait for the Child to reach 21 and then Child can file petition for you.

You and your wife must make sure that you do not overstay your B-2 status in the US. You can apply for an extension of stay if you need additional time to remain in the US following the birth of the child. However, you cannot remain indefinitely in the US just because your child was born here and is a US citizen. Good luck.
