If a naturalization application is denied initially, a new hearing may take place before an immigration judge. After a new hearing request is filed, it is to be scheduled within 180 days and the immigration judge is to decide whether to grant or deny naturalization. If the judge does not make a decision within 120 days of the new hearing, the non-citizen alien may apply to his/her federal district for jurisdiction. The federal district court may then grant naturalization or remand the matter to USCIS with further instructions.
