245 - Adjustment of Status of Non-Immigrant to that of Permanent Resident

Non-citizens, in order to be eligible for adjustment of status, must show that they meet the statutory requirements of section 245.

In general, non-citizens must show that they:
1. Have been inspected and admitted into the United States (any illegal inspection and/or admittance is void);
2. Must be eligible for a permanent resident visa by not being "inadmissible" under INA ยง 212(a); AND
3. Must apply for an available immigrant visa when submitting an application.
