The following situations apply to non-citizens who fail to comply with Removal proceedings.
Any non-citizen who: 1. Willfully fails or refuses to depart the United States within a period 90 (ninety) days from the date of the final order of removal; 2. Willfully fails or refuses to apply in good faith for travel documents; 3. Connives or conspires to hamper their departure; OR 4. Willfully fails or refuses to present themselves for removal at the time and place required as indicated in the removal order.
However, any non-citizen who is taking proper steps to secure cancellation of removal or other relief, does not violate the statute under INA ยง 243(2).
