240 - Removal Proceedings

Although an alien is not a US citizen he or she is still entitled to some Due Process. The following are some basic requirements:
1. Proper Notice given to the non-citizen;
2. Non-citizen may choose an attorney for representation;
3. Non-citizen may choose to offer and cross-examine evidence against him/herself;
4. A removal decision must be based upon "reasonable, substantial, and probative evidence."
