Attorney General Decision Establishes New Precedent for Setting Bond

The Attorney General has issued a precedent decision in a bond proceeding holding that Immigration Judges and the Board of Immigration Appeals must consider “evidence” from executive branch sources that the release of certain aliens would serve to stimulate mass migration and threaten national security. 

The case is In re D-J-, 23 I&N Dec. 572 (AG 4/17/03), Int. Dec. 3488.
