Unmarried Adult Son or Daughter of LPR (F2B)
If you are a U.S. legal permanent resident (LPR) living in the U.S. and you have any unmarried sons or daughters over the age of 21 then you may file a petition to allow them to enter the U.S. and ultimately obtain LPR status.  Unfortunately sons or daughters of LPRs over the age of 21 do not qualify for Immediate Relative status because they are over 21 and the petitioner is not a U.S. citizen.  Instead, the adult son or daughter may qualify for the "F-2B" family preference. 

To qualify for this category, the adult son or daughter must have met the legal of definition of "child" when s/he was under the age of 21.  If the adult son or daughter has any children (LPR petitioner's grandchildren) under age 18 at the time of filing, they would be automatically included in the petition as derivative beneficiaries.

If the unmarried adult son or daughter becomes married before a petition has been approved, s/he will be automatically disqualified from the F2B category.  There is no such preference category for a "married son or daughter of a legal permanent resident" under the Immigration and Nationality Act (INA).  The INA defines a son or daughter as a person who was once a child, but is now either married or over the age of 21. 

Visa Availability
Approximately 26,300 visas will be allocated to the the unmarried adult son or daughter over 21 in this family preference category.  If an LPR has more than one adult son or daughter each must have an (1) approved I-130 petition and (2) an available visa number before Adjusting Status in the United States or Consular Process overseas. 

There is usually a long waiting list in this category, and depending on the beneficiary's country of chargeability, s/he may have to wait several years before having the opportunity to become an LPR.  To check the current waiting list for this preference category visit the Department of State's Visa Bulletin.

  2. Son or Daughter is over the age of 21 and unmarried
  3. Son or daughter must not have committed certain criminal or immigration law violations (although a waiver may be available)
  4. Son or daughter must have been admitted or paroled into the United States and they must be in lawful immigration status with certain exceptions (if applying for adjustment of status)
  5. If a step-parent, the parent-child relationship must have been established prior to the son or daughter's 18th birthday
  6. If an adopted or orphan child, the parent-child relationship must have been established prior to the child's 16th birthday
  7. A visa number must be available at the time of filing for adjustment (or consular processing)
