A U.S. Citizen (USC) may petition for his/her foreign
national parent(s). The USC must be at least 21 years of age in order
to petition for his/her parent(s). A foreign national "parent" is an
individual who is such by reason of his/her relationship to his/her
"child" within the statutory definition of INA § 101(b)(1) at the time
their relationship was established. That parent-child relationship must
continue to exist at the time when the immigration petition is filed.
Adopted / Step Child-Parent Relationship 1)
If the USC was adopted: (a) the adoption must have been finalized
before the child's sixteenth (16th) birthday; (b) Parent(s) must have
legal custody of the child for two (2) years before or after the
adoption; and (c) the child must reside with the adoptive parent(s) for two (2) years before or after the adoption. N.B. - Adopted children may never petition for their natural birth parents.

If the USC is a stepchild of an alien parent, the current marriage of a
parent must have taken place before the child's eighteenth (18th)
birthday.
Visa Availability When
a petition is approved for the husband, wife, parent, or unmarried
minor child of a USC, these persons are classified as immediate
relatives. These beneficiaries do not have to wait for a visa number because they are considered immediate relatives and are not subject to the immigrant visa quotas as the F1, F2A, F3, and F4 family preference categories.
